1. Acceptance of Terms
By accessing or using HowManyFPS ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
2. Description of Service
HowManyFPS provides tools and calculators for estimating gaming performance, including FPS calculations, hardware comparisons, and system requirement analysis. The Service may include both free and premium features.
The Service also includes HowManyFPS, a free desktop application that automatically benchmarks your PC during gameplay. HowManyFPS collects hardware performance data (FPS, GPU/CPU usage, temperatures, clock speeds) and periodic gameplay screenshots to identify in-game scenes.
All performance estimates are approximations based on available data and should be used for informational purposes only. Actual gaming performance may vary.
3. User Accounts
To access certain features, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized use
4. Premium Subscriptions and Payments
Premium features are available through paid subscriptions. By purchasing a subscription:
- No Refunds: All payments are final and non-refundable
- Recurring Billing: Subscriptions automatically renew unless cancelled
- Price Changes: We may modify subscription prices with reasonable notice
- Cancellation: You may cancel at any time; access continues until the billing period ends
5. HowManyFPS Desktop Application
By installing and using HowManyFPS, you agree to the following:
- Data Collection: HowManyFPS collects hardware performance metrics (frame rates, GPU/CPU usage, temperatures, clock speeds) and captures periodic gameplay screenshots during gaming sessions
- Benchmark Visibility: All benchmark data and screenshots are private by default. You may choose to publish benchmarks to make them publicly visible. Published benchmarks can be set back to private at any time
- Data Sync: Benchmark data is synced to your HowManyFPS account and accessible via the website
- Internet Cafe Use: Cafe operators may deploy HowManyFPS across their fleet. Performance data collected from cafe PCs is visible to the cafe account owner. Players are not required to have individual accounts
6. Intellectual Property
All content, features, and functionality of the Service are the exclusive property of HowManyFPS or its licensors. You may not:
- Copy, modify, or distribute any content without prior written consent
- Use automated systems to extract data from the Service
- Reverse engineer any software components
- Use our trademarks without authorization
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Transmit any viruses, malware, or harmful code
- Collect or harvest user data without consent
8. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that results will be accurate or reliable.
9. Limitation of Liability
To the maximum extent permitted by law, HowManyFPS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.
11. Governing Law
These Terms shall be governed by the laws of the jurisdiction in which HowManyFPS operates. Any disputes shall be resolved in the courts of the applicable jurisdiction.
